Preamble:
The [MTawreed] mobile application (the “Application”) is owned and provided by Ms M Tawreed for Ecommerce QFZ LLC in Qatar as a service to our customers (“User/s”) either natural person or legal entity.
Your acceptance of these terms of use constitutes your unconditional agreement to follow and be bound by these terms and conditions (the "Terms & Conditions") which you hereby confirm that you have read, understood and accepted all contents.
We reserve the right at our absolute discretion to change the Terms & Conditions from time to time with or without notice to you. Any such changes will take effect when posted or prompted by the Application.  It is your responsibility to read the Terms & Conditions on each occasion and your continued use of the Application shall signify your comprehension and acceptance to be bound by the latest Terms & Conditions. If you do not agree to (or cannot comply with) any of the Terms & Conditions, you must not use this Application.
This Application may contain links to other applications or websites operated by parties other than us. In such cases we are not responsible for the privacy practices or the content of such websites. You hereby confirm that you are aware of the risks and threats connected with electronic data transmission.

1. Application Consistency and Security:

You are prohibited from violating the security of the Application, including, without limitation, (a) accessing data not intended for such user or logging onto a server or an account which the user is not authorized to access; (b) attempting to probe, scan or test the exposure of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Application, overloading, flooding, spamming, mail bombing or crashing; (d) sending unsolicited email, including promotions and/or advertising of products or services. Violations of system or network security may result in civil or criminal liability. We reserve the right to investigate such violations and prosecute users who are involved in such violations. You agree not to use any device, software to interfere or attempt to interfere with the proper working of this Application or any activity being conducted on this Application. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, robots, avatars) to navigate or search this Application other than the search engine and search agents made available by the Application.

2. The Application can be used only by individuals or entities who can form legally binding contracts under applicable law. Individuals who are incompetent to contract are not eligible to use the Application. If your age is below that of 18 years, your parents or legal guardians can transact on behalf of you if they are registered users/members.
3. We reserve the right to terminate your registration and refuse to provide you with access to the Application if we discover that you are under the age of 18 years. You are legally and financially responsible for all uses of this Application under your username and password whether or not actually or expressly authorized by you.
4. The Application cannot be accessed by persons whose registration has been suspended or terminated for any reason whatsoever. Those who choose to access this Application from outside Qatar are responsible for compliance with local laws if and to the extent local laws are applicable.
5. Entities should provide proper and valid identification documents, in order to complete their registration.
6. Objectionable Material:

You understand that by using this Application or any services provided on the Application, you may encounter content that may be deemed by some to be offensive, indecent, or objectionable, which content may or may not be identified as such. You agree to use the Application and any service at your sole risk, and that to the fullest extent permitted under applicable law, [MTawreed] and its affiliates shall have no liability to you for content that may be deemed offensive, indecent, or objectionable to you.

2. The User agrees that the information provided upon registration (‘’Registration Data’’), at the time of subscription, and at all other times, is true, accurate, current, and complete. This includes but is not limited to personal information, health information, and email address. The User shall notify the Application Administration immediately of any changes to its personal information by updating its User profile on the MTwareed Application.
3. In the event of providing false, inaccurate, or incomplete information, or if the Company has reasonable grounds to suspect that such information is false, inaccurate, or incomplete, or not in accordance with this User Agreement, without prejudice to any other rights and remedies under this User Agreement or at law, the Company has the right to indefinitely suspend, limit, or withdraw the User’s access to MTawreed Application.
4. The information (the "Information") provided from your end will be protected in accordance with our Privacy Policy. If you use the Application, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We assume no liability to any person for any loss or damage which may arise as a result of any failure by you in protecting your password or account.
5. Any suspicious activities on your account shall be notified to us by contacting us immediately through the address provided below. If we have any reason to believe that there is likely to be a breach of security or misuse of the Application, we may require you to change your password or we may suspend your account without any liability to us.
6. Description of the Services, and user’s responsibility
7. MTawreed Application is a platform that allows the User to connect with Third-parties contractors listed on it, among other functionalities. As such, MTawreed Application acts exclusively as an intermediary in connection with the Users and the Service providers.
8. MTawreed Application allows the Users to Look for Competent Services providers for transporting and delivering Goods and materials from certain Location to another. that is to be precisely described by the user.
9. The User shall at his responsibility describe precisely the goods or materials needed to be transported Including the kind, Size, weight and Quantity of the good or materials needed to be transported.
10. Whenever required for the entry of any location, it’s the user’s responsibility to obtain such permits,

• Were the materials needed to be transported completely differ from the description provided by the user, it’s the company’s sole discretion to continue or cancel such order, in such case, the cancelation policy should apply.

1. The User shall at his responsibility determine the exact pickup/loading location and delivering / unloading location as well, in addition to any other information shall be known by the service provider, in order complete the order Whenever required for the material needed to be shipped special equipment, or to be delt with, that were not ordered, or available through the application, it’s the user responsibility to make available of such equipment.

• The User shall at his own responsibility Specify the suitable transportation mean, the required fittings, and equipment’s that matches the transportation requirement for the goods or materials needed to be transported.
• Were the user in need for additional workers for loading or unloading the shipment, it is his responsibility to define the number of the needed workers, whose charges shall be born solely by the user.

1. The user acknowledges that, the waiting hours permitted prior to proceeding with any shipment, shall be defined by the company according to it’s policy.

The user declares his commitment to insure the good or material requested to be transported, whereas such insurance should cover the value of such material or goods against any damage or accident that might occur within the transportation.

• It’s understood by the user that, for any reason, the transportation might be interrupted prior to it’s completion, in such case, the company at it best endeavors shall do the necessary towards the continuation the requested services, however, under any circumstance, the company’s maximum liability shall only be limited to the charges paid by the user in return for the requested service.
• The User shall have the right for the cancellation of the service order 3 hours before the specified transportation time, however, there might be a cancellation fees to be charged thereof.

1. It’s the user’s responsibility to confirm the completeness of the services provided to him, however, the laps of 24 hours without any communication from the user side, MTawreed shall consider the services has been completely and successfully provided.

• The Users shall have the right to leave reviews concerning the quality of the services provided by the Services providers. The reviews may take the form of text or pictures and shall be subject to the review guidelines stated hereafter.
• The services offered on MTawreed Application are subject to payment terms detailed hereafter.
• MTawreed does not verify and, therefore, does not guarantee, in any way:
• The credentials, representations, or quality of the services provided by the Services providers contractors.
• That the Services providers are in compliance with applicable laws or regulations governing the service advertised;

1. Service charge:

It’s understood and fully acknowledged by the user that, it’s at the company’s sole discretion to determine the charge for each requested service, and the user shall have no option but to accept or cancel the requested service order through the application.
It’s fully acknowledged by the user that, for any provided service, the user shall not be entitled for any discount or reduction, unless agreed and provided by the company.
The User acknowledges that, Errors may occur in the process of providing services and pricing information by the Application. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we shall have the right, at our sole discretion, to contact you for information.
Prices and availability are subject to change without any prior notice, in accordance with the policy of our various suppliers and/or service providers.

1. Payment
2. you understand that use of the Services may result in charges to you for the services you receive from a Third-Party Provider (“Charges”). After you have received services or goods obtained through your use of the Service, MTawreed will facilitate your payment of the applicable Charges on behalf of theService Provider as Service Provider’s limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Service
3. Charges will be exclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by us.
4. All Charges are due immediately and payment will be facilitated by MTawreed using the preferred payment method designated in your Account, after which MTawreed will send you a receipt by email. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that MTawreed may, as the service Provider’s limited payment collection agent, use a secondary payment method in your Account, if available.
5. As between you and MTawreed, MTawreed reserves the right to establish, remove and/or revise Charges for any or all services or goods obtained through the use of the Services at any time in MTawreed’s sole discretion. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand. MTawreed will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. MTawreed may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you.
6. You may elect to cancel your request for any services from a service Provider at any time prior to such service Provider’s arrival, in which case you may be charged a cancellation fee.
7. MTawreed does not designate any portion of your payment as a tip or gratuity to the Third-Party Provider. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third-Party Provider who provides you with services, you are under no obligation to do so. Gratuities are voluntary. After you have received services or goods obtained through the Service, you will have the opportunity to rate your experience and leave additional feedback about your service
8. Cancellation Fees:

By accepting these Terms and Conditions, you accept to be charged a minimum cancellation fee that will be determined by us from time to time and that will apply to cancellations of services ordered through the Application.  The said fee will be determined on a case-by-case basis through a pop-up box through the Application.

   1. When you visit the Application or send emails to [insert communication e-mail address], you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Application. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
2. Copyright and Trademark:

Unless otherwise noted, all contents of the Application are copyrights, trademarks, trade dress and/or other intellectual property owned, controlled or licensed by MTawreed company, or one of its affiliates or by third parties who have licensed their materials to the Application, and are protected by the applicable laws.
4. MTawreed expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials, which appear on this Application. Access to this Application does not confer and shall not be considered as conferring upon anyone any license under any of our or any third party's intellectual property rights. All rights, including copyright, in this Application are owned by or licensed to [MTawreed]. Any use of this Application or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of [MTawreed]. You may not modify, distribute or re-post anything on this Application for any purpose.
5. MTawreed’s names and logos and all related product and service names, design marks and slogans are the trademarks of [MTawreed]. No trademark license is granted in connection with the materials contained on this Application. Access to this Application does not authorize anyone to use any name, logo or mark in any manner whatsoever.
6. User’s Prohibited Behavior
7. The User cannot access or use the MTawreed Application for any other purpose other than that for which the Company makes it available, or in any manner that is inconsistent with all the applicable laws and regulations, whether local, national, or international law.
8. Prohibited activities include but are not limited to the following:
9. To deliver or transport any material that is, unlawful, and contradicts with the applicable laws
10. To use any part of the ____ Application or any information obtained from it to harass, abuse, or harm any other person.

• Impersonate others or use inaccurate information or create an account for a third person without having their express permission.

1. To harass, annoy, intimidate, or threaten the Company through any medium of communication or to any of its employees or agents engaged in providing any part of the Company or the Application services.
2. To transmit any material that violates any copyright, trademark, patent, or any other intellectual property, moral rights, artist rights, of any third party, or to facilitate the unlawful distribution of copyrighted content or illegal content, or to delete the copyright or other proprietary rights notice from any contribution or the MTawreed Application Content.
3. To use the service for any commercial purposes, except as expressly permitted under these Terms of Use;

• To commit an act that interferes with or impair the intended operation of the Application. This includes misusing any reporting, dispute channels;
• To retrieve systematically any data or other content from MTawreed Application to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from the Company;

To attempt to tamper with or alter any aspect of a user’s account (including the Username) without the account holder's consent, or solicit, illegally collect or use login credentials or badges of other Users, or solicit or collect Application’s usernames or passwords, or traffic or access codes in a way or for an intent that does not comply with the Terms of Use of the Application or its Data Policy.
2. To modify, translate, create derivative works of, or reverse engineer the Company products or their components;
3. To perform any other suspected malicious activities on MTawreed Application, or commit any act that constitutes a criminal offense and may result in civil liability or otherwise breaches any laws, regulation, codes of practice, any provision of the Terms of Use, or the rights of the Company.

• To transmit chain letters or junk emails to other users
• To use any information obtained from the MTawreed Application in order to contact, advertise to, solicit, or sell to any User without their prior explicit consent;
• To engage in any automated use of the system to extract data such as the use of bots or similar data collection and extraction tools;
• To interfere with, disrupt, or create, an undue burden on the Application or the networks or services connected to the MTawreed Application

1. If the User fails, or the Company suspects on reasonable grounds that the User failed, to comply with any of the provisions of this Agreement, or if the User commits any of the prohibited activities, the MTawreed Administration may, without prior notice to the User, suspend, block or terminate the User’s account and prevent his/her/ its access to log into the service. The Company has the right to refuse to provide or stop providing all or part of its services or privileges immediately to protect the community or any of the Company’s services or rights.
2. Authority of the Company
3. The Company has the right to temporarily suspend or completely cease the MTawreed Application system operation at any time. It reserves the right to change or discontinue any of its services at any time.
4. The Company shall not have any responsibilities against the Users of MTawreed Application or any third parties due to the temporary suspension or complete cessation of the operation system.
5. The MTawreed Application seeks to continue providing its services and maintain a high level of this service and its best quality in a safe and fast manner. However, for reasons not related to the performance of the Application Administration, the MTawreed Application does not guarantee the availability of its services on time in a safe and complete manner, or that the results obtained from the services are correct and reliable, or that the quality of service meets the expectations of Users on a regular basis.
6. The Company may change the services, may provide additional services, change some of the services partially or completely.
7. The MTawreed Application seeks to continue to provide its services and maintain a high level of this service and its quality in a safe and fast manner, which requires the Company to periodically carry out modifications, updates, and maintenance work on the MTawreed Application and its operating systems. Therefore, the MTawreed Application may not be available at certain times especially during the said maintenance and updates. Although Users are not guaranteed being notified on the said issues, the Application Administration will endeavor with all efforts to notify customers in advance that any service is not available / if this happens.
8. The Company may terminate this User Agreement unilaterally at any time. It further reserves the right to modify, suspend, or discontinue the services (or any part or content thereof), at any time without prior notice to the User, and to the full extent permitted by law. The Company will not be liable to the User or any third party should it exercise such rights.
9. Advertisement:
10. The User also agrees to receive advertisements through the email address or/and through SMS. Nevertheless, and in case of any commercial engagement or purchasing activity that takes place between the User and the Advertising entity, MTawreed Application:
11. Does not provide the option to its Users to order any product or service through the Application;
12. MTawreed Application is not a party to contracts concluded between the Advertising entities and Buyers who are Users of the Application;

• Does not control in any manner any transaction resulting from this engagement;

1. Further to the provisions aforesaid, MTawreed Application does not verify, and therefore, does not guarantee in any way:
2. The credentials, representations, or quality of the products advertised on the MTawreed Application;
3. The quality, safety, and soundness of the products and services advertised on the Application;

• That the products displayed in these advertisements match the actual products or services provided by the advertising entities;

1. That the advertising entity complies with applicable laws or regulations governing the product/service advertised.
2. All information regarding the partners, their products, and their services advertised in the MTawreed Application are the sole responsibility of the advertisers MTawreed Application shall not be responsible for any damage or injury that may be caused by any products and services displayed on the Application.
3. Contracts held between any of the Users and any of the advertisers (Services or products) shall be strictly bipartite contracts between the Advertiser and the Buyer. At no time shall any right, title, or interest over any product or service vest with the MTawreed Administration nor shall the MTawreed Administration have any obligations or liabilities in respect of such product and service or the contract between the User and the advertiser.
4. Links to and from other web applications
5. As a courtesy to the User, the MTawreed Application may offer links to other web applications. The Company is not responsible for the content and nor can guarantee the accuracy, completeness, or timeliness of information in third-party web application pages of any web application pages created and maintained by organizations independent of the MTawreed Application.
6. Visiting any such third-party web application pages is at the User’s own risk and the use of such information is voluntary.
7. Any reference to commercial products or services within any such third-party application pages does not constitute or imply any endorsement by MTawreed Application or the Company.
8. By using the Application, the User acknowledges that MTawreed Application and the Company are responsible neither for the availability of, the content located on it, not or through any third-party web application pages.

Indemnity:

1. You agree to defend, indemnify and hold harmless M’s MTawreed Company and its affiliates from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your misuse of the Application of our violation to these Terms & Conditions and/or the applicable laws.
2. Suspicious activity:

The Company reserves the right to suspend the User’s account if:

• The User frequently cancels its reservations or does not meet its reservation regularly;
• Performs suspicious transactions to harm, fraud, manipulate the data in any way.

1. User Liability:
2. The User shall pay the Company for all costs and damages which it incurs as a result of breaching any of the restrictions set forth on these Terms of Use.
3. MTawreed Application will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or location of anyone posting any material in breach of any of the obligations under the User Agreement.
4. MTawreed Application may, in its sole discretion and at any time, make any inquiries it considers necessary (whether directly or through a third party), and request for the User to provide further information or documentation to verify the User’s identity such as trade license, other incorporation documents, and/or documentation showing any person’s authority to act on behalf of the User. Any refusal to provide the said documents is a breach of the Terms of the Agreement and therefore allows the Company to suspend or withdraw the User’s access to the Application.
5. The Company shall not be responsible for any damages which may arise from the behavior of the User while using MTawreed Application when in violation of this User Agreement.
6. Limitation of Liability:
7. 1. MTawreed or any of its affiliates, employees, directors, agents or suppliers shall not be liable to you or to any other person for any indirect, special, incidental or consequential losses or damages of any nature arising out of or in connection with the use of or inability to use the Application, including without limitation damages for loss of profit, accuracy of results, loss of data, work stoppage, or computer failure. Without prejudice to the generality of the section above, the total liability of MTawreed to you for all liabilities arising out of these Terms & Conditions is it in tort or contract is limited to the value of the services ordered by you.
8. MTawreed make no representations or warranties about the accuracy, reliability, completeness, correctness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Application or that the operation of the Application will be error free and/or uninterrupted. Consequently, MTawreed assumes no liability whatsoever for any monetary or other damage suffered by you on account of the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Application; and/or any interruption or errors in the operation of the Application.
9. The company shall not be liable for any damages or losses resulting from any issues related to the quality, type, quantity, number, or model of the services provided by the service provider, or manpowerr requested by the user. The user shall be responsible for verifying the quantity, weight, kind, and quality of any the material requested to be shipped or transported.
10. Privacy Policy:

You may be asked to provide your personal information anytime you use our services. We may share this information internally and use it consistent with this Privacy Policy. We may also combine it with other information to provide and improve our services, website content, and advertising. You are not required to provide the personal information that we have requested, but, if you chose not to do so, we may not be able to provide you with our services or respond to any queries you may have. We may also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. We may share personal information with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering services to you, managing and enhancing customer data, providing customer service, assessing your interest in our services, and conducting customer research or satisfaction surveys. These companies are obligated to protect your information. We may also share your information if it is necessary by law, legal process, and/or requests from public and governmental authorities for us to disclose your personal information.

1. Termination:

These Terms & Conditions are effective unless and until terminated by either you or [MTawreed]. You may terminate these Terms & Conditions at any time, provided that you discontinue any further use of this Application. In case you violate the Terms & Conditions, we may terminate these Terms & Conditions at any time and may do so immediately without notice, and accordingly deny you access to the Application. Such termination will be without any liability to us. Upon any termination of these Terms & Conditions by either you or us, you must promptly destroy all materials downloaded or otherwise obtained from this Application, as well as all copies of such materials, whether made under these Terms & Conditions or otherwise. Any such termination of these Terms & Conditions shall not cancel your obligation to pay for the product already ordered from the Application or affect any liability that may have arisen under these Terms & Conditions.

1. Amendment of the Terms and Conditions:

We may at any time modify the Terms & Conditions without any prior notification to you. You can access the latest version of the Terms & Conditions at any given time. In the event the modified Terms & Conditions are not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of this Application.

1. Entire Agreement:

If any part of these Terms & Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms & Conditions shall continue in effect. Unless otherwise specified herein, these Terms & Conditions constitutes the entire agreement between you and [Name of the Company] with respect to this Application and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and [Name of the Company] with respect to this Application. [Name of the Company]’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.

1. Enforcement:

If any part of this User Agreement is deemed unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this Users Agreement and shall not affect the validity and enforceability of any of the remaining provisions. No waiver by the Company or MTawreed Application shall be construed as a waiver of any preceding or succeeding breach of any provision.

1. Governing Law and Jurisdiction:

The Terms & Conditions shall be construed in accordance with the local laws and regulations of Qatar. The Courts at Qatar shall have exclusive jurisdiction in any proceedings arising out of the Terms & Conditions.

1. Internet Delays

The Company’s service and software may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. The Company is not responsible for any delays, delivery failures, or other damage resulting from such problems.
